HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL AND BEHAVIORAL HEALTH INFORMATION ABOUT YOUR CHILD MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Our Commitment to Your Privacy
Learn Through Play ABA is committed to protecting the privacy of your child’s health information. We are required by law to maintain the privacy of Protected Health Information (PHI), to provide you with this Notice of our legal duties and privacy practices with respect to PHI, and to notify you in the event of a breach of unsecured PHI.
How We May Use and Disclose Health Information
The following describes the ways we may use and disclose health information about your child. For each category of use or disclosure, we will explain what we mean and give some examples.
Treatment
We may use and disclose your child’s PHI to provide, coordinate, or manage their ABA therapy and related services. For example, we may disclose PHI to other healthcare providers involved in your child’s care, such as pediatricians, speech therapists, or occupational therapists, with your authorization.
Payment
We may use and disclose your child’s PHI to obtain payment for services rendered. This may include submitting claims to health insurance companies or Medicaid.
Health Care Operations
We may use and disclose PHI for our internal healthcare operations, such as quality improvement, staff training, and administrative functions necessary to run the practice.
Required by Law
We will disclose PHI when required to do so by federal or state law, including New Jersey law.
Public Health Activities
We may disclose PHI for public health activities as permitted by law, such as reporting certain communicable diseases to public health authorities.
Abuse or Neglect Reporting
As required by New Jersey law, we are mandated reporters. We may disclose PHI to appropriate authorities when we reasonably believe a child is the victim of abuse or neglect.
Business Associates
We may share PHI with third-party vendors (“Business Associates”) who perform services on our behalf, such as billing companies or electronic records systems. Business Associates are contractually required to protect your information.
Your Rights Regarding Your Child’s Health Information
You have the following rights with respect to your child’s PHI:
- Right to Access: You have the right to inspect and obtain a copy of your child’s PHI held in our records. Requests must be submitted in writing.
- Right to Amend: You may request that we amend your child’s PHI if you believe it is inaccurate or incomplete.
- Right to an Accounting of Disclosures: You may request a list of disclosures we have made of your child’s PHI, with certain exceptions.
- Right to Request Restrictions: You may request restrictions on certain uses and disclosures of your child’s PHI. We are not required to agree to all restrictions.
- Right to Confidential Communications: You may request that we communicate with you about your child’s health information in a specific way or at a specific location.
- Right to a Paper Copy: You have the right to receive a paper copy of this Notice at any time, even if you have agreed to receive it electronically.
- Right to File a Complaint: You have the right to file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights if you believe your privacy rights have been violated. To file a complaint with HHS, visit www.hhs.gov/ocr/privacy/hipaa/complaints/.
Uses and Disclosures Requiring Your Authorization
For uses and disclosures not described in this Notice, we will obtain your written authorization before using or disclosing your child’s PHI. You may revoke your authorization at any time in writing, except where we have already taken action in reliance on it.
Changes to This Notice
We reserve the right to change this Notice. Changes will apply to PHI we already hold as well as PHI we receive in the future. The current Notice will always be available on our website and in our office.
